CHANDLER, ARIZONA, January 20, 2009 - ISOLA GROUP, SARL, a leading designer, developer and manufacturer of high performance base materials for the printed circuit board industry, today announced their attorneys received a copy of the Taiwan Intellectual Property Court's ruling on January 17. According to the Ruling, Isola's request for Preliminary Injunction was not granted primarily because TU662 and TU752 were on the market for quite some time, therefore, there was no urgent need for the preliminary injunction. The preliminary injunction would have only provided a temporary suspension to the infringing production/sales and would still have required a civil court ruling for the ultimate resolution.
While the decision is disappointing, Isola is pleased with the Court's findings with regard to the validity of the patent. The Court carefully considered the alleged prior art patents cited by TUC and came to the conclusion that the Isola patent has novelty and inventive step and thus is valid.
According to the Ruling, Isola can file an appeal with the Intellectual Property Court within 10 days of receipt of the Ruling. Isola plans to initiate civil action and will present positive evidence that will clearly demonstrate that the TUC products (TU662 and TU752) infringe Isola's patents. Isola has also filed a complaint with the US International Trade Commission requesting an exclusion order that will bar importation of TUC products (TU662 and TU752) because they infringe Isola's equivalent U.S. patents.
Isola would like this issue to be resolved in an expeditious manner through the legal system.
